Council Directive 91/676/EEC (consolidated version as of 11 Dec 2008)

Council Directive 91/676/EEC aims to protect surface and groundwater across the EU from pollution caused by nitrates originating from agricultural sources. It addresses rising nitrate concentrations, eutrophication risks, and the environmental pressures created by excessive fertilizer and manure use.

Member States must identify waters that are polluted or at risk, based on criteria such as concentrations exceeding 50 mg/L nitrates or evidence of eutrophication. They must then designate Nitrate Vulnerable Zones (NVZs)—areas draining into affected waters—and implement mandatory Action Programmes in these areas, including limits on nitrogen application, storage requirements for livestock manure, and restrictions on spreading during high‑risk periods. The Directive also requires Codes of Good Agricultural Practice to be applied voluntarily nationwide and mandatorily within NVZs; these codes cover fertiliser timing, slope restrictions, winter cover crops, and manure management. Member States must conduct regular water monitoring, reassess NVZ designations and action programmes at least every four years, and report progress to the European Commission.

As a core component of EU water protection legislation, the Directive supports broader goals under the Water Framework, Marine Strategy, and Green Deal strategies.
